Legal requirements for an intending couple

  

  • Both parties must be at least 18 years of age or at least one party is 18 years of age and the other person has obtained parents' authorisation and a court order giving permission to be married.
  • The Notice of Intended Marriage (NOIM) must be completed, signed, witnessed and lodged with me not less than one month and one day and not more than 18 months prior to the wedding date.
  • You must also sign declarations closer to the ceremony date stating that you are not aware of any impediment to the marriage.
  • If born in Australia, you must produce original copies of their birth certificate or an extract from the Registry of Births, Deaths and Marriages, if not available.
  • If born outside Australia and your birth certificate is not available, you may produce your passport from your country of origin, showing the date and place of birth.
  • If previously married, you must produce original decree absolute, certificate of divorce or certificate of death, whichever is applicable.
  • Two people over 18 years of age must be present at the ceremony to sign as witnesses.
